SUBSCRIBER SUES MTN FOR DISCLOSING CALL RECORDS

A SUBSCRIBER, Agbamu Gibson, has sued MTN Nigeria Communications Limited, alleging that the network unlawfully disclosed his call records to persons he does not know, and claiming damages.
Gibson’s suit was filed through his counsel, Andrew Anibor, at the Federal High Court, Warri. The Guardian learnt MTN, through its counsel, Jonathan Ekperusi, admitted that it released the call detail records (CDR) of the subscriber’s No 08037725218 to the State Security Service (SSS) upon a request contained in a letter with reference number S.43/2845, dated October 3, 2013, and signed by D.E Egbeji, FSI.
However, Gibson said that all through his life, he had never had anything to do with crime and had never had anything to do with any law enforcement agency, including SSS, which MTN alleged, requested for his mobile number for security reasons.
Agbamu’s counsel also disclosed that the SSS did not address the said letter to MTN Nigeria Communications Limited but to MTN Nigeria, Lagos, “an entity he is not aware of its existence under Nigerian Law.”
The case comes up for mention at the Warri High Court on January 30.
